Conditions of Service

1. Purpose

These Conditions of Service govern the subscription, access and use of the menta® application, intended for the management of microbial collections, strains, batches, controls and associated documentation, including traceability and versioning.

2. Acceptance of the conditions

Subscription to and use of the service imply full acceptance of these Conditions of Service. The user acknowledges having read, understood and accepted their contents.

3. Subscription and licensing

  • Use of menta® requires subscription to a license or service plan.
  • Licenses are granted on a non-exclusive and non-transferable basis.
  • No intellectual property rights over the software are transferred to the user.

4. Data ownership and export

  • All data entered, managed or generated by the user through menta® shall remain the exclusive property of the user at all times.
  • The user has the right to request a complete export of their data at any time, both during the term of the service and after its termination.
  • Standard data export shall be performed by means of a structured dump of the data as stored in the system database, using open and widely adopted formats such as CSV, Excel and/or JSON, without transformations or adaptations to external systems.
  • The user may choose to export the current state of the data, the complete change history, or both.
  • Standard data export shall be provided free of charge. Any additional services related to data adaptation, transformation, customized preparation or technical assistance for migrations may be offered as separate, chargeable services.
  • menta® does not implement any form of data lock-in or technical restrictions intended to prevent data reuse by the user.

5. Pricing and payment conditions

  • Prices for licenses or plans will be communicated in advance.
  • Payment shall be made using the available payment methods.
  • Failure to pay may result in suspension or termination of access.

6. Support and updates

  • Reasonable technical support shall be provided according to the subscribed plan.
  • Application updates may be provided automatically or upon prior notice.

7. Duration and termination

  • The contract duration corresponds to the subscribed plan.
  • The user may terminate the contract with at least 15 days prior notice.
  • The provider may terminate the contract in case of breach or non-payment.

8. Limitation of liability

  • menta® is provided “as is”.
  • The provider shall not be liable for indirect damages or data loss.
  • Maximum liability shall be limited to the amount paid by the user in the last 12 months.

9. Data protection

Personal data processing shall be governed by the Privacy Policy and applicable data protection regulations. The user is responsible for the legality of the data entered into the system.

10. Modifications

The provider may modify these Conditions of Service at any time, with reasonable prior notice to active users.

11. Governing law and jurisdiction

These Conditions of Service are governed by Spanish law. Any disputes shall be subject to the jurisdiction of the courts of Valencia (Spain), unless otherwise required by law.
