These Terms of Use govern the rules applicable to the use of the menta® application. They are distinct from the Conditions of Service, which regulate subscription, licensing, pricing and contractual aspects of the service.
2. Account and access
- Access may require a user account and credentials.
- The user is responsible for safeguarding credentials and all activity under their account.
- Information provided must be accurate and kept up to date.
- Access may be restricted where misuse or risk is detected.
3. Acceptable use and prohibitions
- Use the service only for lawful purposes.
- No malicious code or actions affecting system integrity.
- No reverse engineering unless legally permitted.
- No unauthorised access attempts.
- No data processing without legal basis.
4. Intellectual property
- The software and related elements remain the property of the owner.
- No transfer of intellectual property rights is granted.
- User data remains under the responsibility of the user.
5. Confidentiality
Non-public information shall be kept confidential during and after use of the service.
6. Personal data and privacy
- Processing is governed by the Privacy Policy and the GDPR.
- The user acts as data controller for their data.
- The provider may act as data processor where applicable.
- The user must ensure legal basis for any personal data processed.
7. Infrastructure, data residency and backups
- The service may be operated on infrastructure located within the European Union.
- Data architecture includes storage, processing and backup systems required for service continuity.
- Backups are encrypted and may be stored in EU-based infrastructures across independent locations.
- Specific data residency requirements may be agreed contractually.
- Backups are intended to ensure data integrity, continuity and recovery.
8. Security and availability
- Appropriate technical and organisational measures are applied.
- No system is completely fail-safe.
- Maintenance may cause temporary interruptions.
- No uninterrupted availability is guaranteed unless agreed.
9. Third-party services
External services may be used and are subject to their own terms.
10. User responsibility
- The user is responsible for their use of the system and data.
- The service does not replace internal compliance obligations.
11. End of service, data export and deletion
- Users may request data export upon termination.
- Data may be deleted after a reasonable period.
- Backup deletion may follow retention cycles.
12. Suspension and termination
Access may be suspended in case of breach.
13. Modifications
Terms may be updated when necessary.
14. Applicable law and jurisdiction
Governed by Spanish law, courts of Valencia.
