1. Purpose
These Terms of Use govern the rules applicable to the use of the Mentabase application by its users, and are distinct from the Conditions of Service governing subscription, licensing and pricing.
2. Account and access
- Access to Mentabase may require the creation of an account and personal credentials. The user is responsible for maintaining the confidentiality of such credentials and for all activities carried out under their account.
- The user undertakes to provide accurate information and to keep it up to date.
- The provider may limit or deny access where there are reasonable indications of misuse or breach of these Terms.
3. Acceptable use and prohibitions
The user undertakes to use Mentabase diligently, lawfully and in accordance with these Terms. The following actions are prohibited, among others:
- Using the application for unlawful, fraudulent or third-party-rights-infringing purposes.
- Introducing or transmitting malicious software, harmful code or actions affecting service availability, integrity or security.
- Reverse engineering, decompiling or disassembling the software, except where legally permitted.
- Accessing or attempting to access restricted areas without authorisation or bypassing technical safeguards.
- Using the application for unsolicited mass communications or in breach of data protection regulations.
4. Intellectual property and content
- The software, code, design, interfaces, documentation and other protectable elements are owned by José Miguel López Coronado or its licensors and are protected by applicable intellectual and industrial property laws.
- The licence granted does not imply any transfer of intellectual property rights.
- Data and content entered by the user remain under the user’s exclusive ownership and responsibility, who declares having the legal basis to process such data.
5. Confidentiality
The parties undertake to maintain the confidentiality of non-public information accessed through use of the service. This obligation shall survive termination of the relationship.
6. Personal data and privacy
Personal data processing is governed by the Mentabase Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Spanish law. The user declares having sufficient legal basis to introduce personal data and to comply with applicable information duties.
7. Security and availability
- Reasonable technical and organisational measures shall be applied to protect the application and data.
- No system is entirely infallible; the user accepts the inherent limitations of online services.
- Scheduled maintenance operations may cause temporary service interruptions, with notice given where reasonably possible.
8. Third-party links and services
The application may integrate or link to third-party services or content, governed by their own terms. The provider assumes no responsibility for such external services.
9. User responsibility
- The user is solely responsible for their use of Mentabase and for all data and content processed through it.
- The user shall indemnify and hold the provider harmless from third-party claims arising from breach of these Terms or applicable law.
10. Suspension and termination of use
The provider may suspend or restrict access in case of breach. Termination does not release the user from previously accrued responsibilities. Contractual and economic terms are governed by the Conditions of Service.
11. Modifications
These Terms of Use may be amended to reflect legal, technical or operational changes. Substantial changes shall be communicated to active users with reasonable prior notice.
12. Applicable law and jurisdiction
These Terms of Use are governed by Spanish law. Any disputes shall be subject to the courts of Valencia (Spain), unless mandatory rules provide otherwise.
